These terms of use govern the use of the Kelly Search API and the website kelly-search.com. The operator is the person named in the Imprint.
Kelly Search provides a web search API whose response format is compatible with the Brave Search API schema. Results are compiled automatically from open, distributed search sources and our own caches. The service is in beta; a best-effort standard applies without availability guarantees.
Usage requires a personal API key. Keys are non-transferable and must be kept secret. Free keys are subject to rate limits. Commercial retrieval at scale, reselling the results as your own search product, and excessive automated load (DoS-like patterns) are prohibited without express written permission.
Search results consist of references to and short excerpts from third-party sites. Rights to the linked content remain with the respective rights holders. Users are responsible for checking the licensing situation of any content they reuse.
The service is provided without warranty for accuracy, completeness, availability or fitness for a particular purpose. Results are generated automatically. Liability for slight negligence is excluded to the extent legally permitted (e.g. except in cases of injury to life, body or health, or fraudulent intent).
In case of violations of these terms, the operator may block keys and delete accounts, in particular in cases of abuse, attacks on the service or unlawful use.
The operator may adapt these terms as the service evolves (in particular when moving from beta to paid tiers). Account holders will be informed of material changes by e-mail.
German law applies. Place of jurisdiction is — as far as legally permissible — the operator's seat.
